Terms of Service

1. Acceptance of Terms

By accessing or using the Homefax platform (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, you may not use the Service.

2. Description of Service

Homefax provides property history reports that aggregate publicly available information about residential and commercial properties. Reports may include ownership history, permit records, tax assessments, environmental data, and other relevant property details.

3. Account Registration

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activity that occurs under your account.
  • You must be at least 18 years old to create an account.

4. Payments & Refunds

  • All prices are listed in US dollars and are subject to change with notice.
  • Payments are processed securely through our third-party payment provider.
  • Subscription plans renew automatically unless cancelled before the renewal date.
  • Credit packs do not expire and are non-refundable once purchased.
  • Refund requests for single reports may be considered within 7 days of purchase if the report was not accessed.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws.
  • Attempt to reverse-engineer, scrape, or systematically download report data.
  • Resell, redistribute, or sublicense Homefax reports without written authorization.
  • Interfere with or disrupt the integrity or performance of the Service.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.

6. Intellectual Property

All content, design, logos, and software associated with Homefax are the property of Homefax or its licensors and are protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without prior written consent.

7. Limitation of Liability

To the fullest extent permitted by law, Homefax and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim shall not exceed the amount you paid to Homefax in the 12 months preceding the claim.

8. Indemnification

You agree to indemnify and hold harmless Homefax and its affiliates from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.

9. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Sections that by their nature should survive termination will remain in effect.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service. Continued use after changes constitutes acceptance of the updated Terms.
